Terms of Service

These terms are an agreement between you and RESCAIVA Digital Solutions ("we", "us") for the use of EMBER. By creating an account you accept them.

1. Who can use EMBER

You must be at least 13 years old.
You need a working phone number able to receive SMS.
You must not be barred from using the service under applicable law, or previously removed from EMBER for violating these terms.

2. Your account

You are responsible for your account and the device it is signed in on. Tell us promptly at support@ember.ng if you believe someone else has access to it. One person per account; do not share it.

3. Acceptable use

You agree not to use EMBER to:

Harass, threaten, bully or stalk anyone
Share content that sexualises children, or any illegal content
Publish someone's private information without their consent
Send bulk unsolicited messages, scams, phishing or fraud of any kind
Impersonate another person or organisation
Distribute malware, or attempt to breach, overload or reverse-engineer the service
Spread content promoting violence, terrorism or self-harm
Infringe anyone's intellectual property

Reporting. Every EMBER profile has Block and Report. Reports reach our moderation team, and we review them. We may warn, suspend or permanently remove accounts that break these rules. Serious matters may be referred to the authorities.

4. Your content

Your messages and media remain yours. You grant us only the limited permission needed to operate the service — to store, transmit and display your content to the people you send it to. We do not use your content for advertising, and we do not sell it.

5. AI features

Translation and summaries are provided for convenience and may be inaccurate. Do not rely on them for legal, medical, financial or other consequential decisions. They run only when you choose to use them; see the Privacy Policy for how the text is processed.

6. Calls and Campfire

Voice calls, video calls and Campfire audio rooms are transmitted live. We do not record them. Call quality depends on your network, and we cannot guarantee that every call will connect.

7. Service availability

EMBER is provided "as is". We work hard on reliability, but we do not guarantee uninterrupted or error-free service. We may change, suspend or discontinue features, and will give reasonable notice of significant changes where we can.

8. Limitation of liability

To the maximum extent permitted by Nigerian law, we are not liable for indirect, incidental or consequential losses, including lost profits, lost data or business interruption arising from your use of EMBER. Nothing in these terms excludes liability that cannot lawfully be excluded.

9. Ending your use

You may stop using EMBER and request deletion of your account at any time. We may suspend or terminate an account that breaches these terms, or where required by law.

10. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria, and disputes fall under the jurisdiction of Nigerian courts.

11. Changes to these terms

We will update this page and the "last updated" date, and notify you in the app of significant changes. Continuing to use EMBER after a change means you accept the updated terms.
